LATEST PROCEDURES FOR IMPORTING NEW CAR TIRES

Vietnam is a country with a developing economy. According to the latest forecast of CEBR, by 2036, Vietnam will be in the top 20 largest economies in the world (G20). Therefore, the demand for automotive products will be very large. Including car tires. However, many businesses still face difficulties when importing this item into Vietnam: not understanding the import procedures, or logistics costs are too high, etc. Understanding the difficulties of customers, HML Supply Chain would like to share the latest experience in importing car tire products.

In addition to customs procedures like normal goods, according to Circular 41/2018/TT-BGTVT, automobile tires (pneumatic tires) must be registered for Quality Inspection and Conformity Declaration before being put on the market.

1. Policies and conditions for importing automobile tires.

Each item will have different import procedures and policies, importers need to clearly understand the import process and policies to avoid risks arising after the goods arrive at Vietnamese seaports.

Automobile tires are on the list of goods that can easily cause unsafety of the Ministry of Transport, specifically:

  • Circular No. 41/2018/TT-BGTVT on the list of goods that can easily cause unsafety of the Ministry of Transport.
  • Issuing QCVN 34:2017/BGTVT on national technical regulations for pneumatic tires for automobiles according to Circular 31/2017/TT-BGTVT
  • Content of Circular No. 38/2015/TT-BTC regulating procedures for importing automobile tires and import tax rates for automobile tires.

Can you import used car tires?

Enterprises should note that used car tires are on the list of prohibited imports according to Government Decree No. 187/2013/ND-CP. Therefore, Enterprises are not allowed to import used car tires.

2. HS Code of tires and labeling regulations

2.1 HS code of tires

According to the latest tariff schedule of the General Department of Customs, unused automobile tires can be applied to one of the following HS codes:

4011: Unused rubber pneumatic tires.
– 40111000 :For use on motor cars (including station wagons and racing cars)
– 401120 :For use on buses (1) or lorries:
– 40112010 :Of a width not exceeding 450 mm
– 40112090 :Other
– 40113000 :For use on aircraft
– 40114000 :For use on motorcycles
– 40115000 :For use on bicycles
– 40117000 :For use on agricultural or forestry vehicles and machinery

401180 :For use on construction, mining or industrial handling vehicles and machinery:
– 40118011 :For use on tractors, machines of heading 84.29 or 84.30, forklift trucks, wheelbarrows or other industrial handling vehicles and machines, with a rim size not exceeding 61 cm:
– 40118019 :Other
– 40118021 :Of a kind used on tractors, machines of heading 84.29 or 84.30, forklift trucks or other industrial handling vehicles and machines; With rim size over 61 cm
– 40118029 :Other

401190 :Other:
– 40119010 :Type for vehicles of Chapter 87
– 40119020 :Type for machines of heading 84.29 or 84.30
– 40119030 :Other, with width over 450 mm
– 40119090 :Other

2.2 Notes on regulations on product labeling:

Product labeling of automobile tires must include at least the following contents:

  • Product name
  • Name and address of the organization or individual responsible for the goods
  • Origin of goods
  • Model, product code (if any)
  • Other contents depending on the type of goods

3. Procedures for importing tires

100% new, unused tires are allowed to be imported without an import license.

However, automobile tires are subject to the national technical regulations on automobile tires of the Ministry of Transport, so conformity certification is mandatory. Tires are subject to Appendix 2 of Circular 41/2018/TT-BGTVT, so conformity declaration is only required after customs clearance.

Step 1: Register for quality inspection of automobile tires

According to Circular 12/2022/TT-BGTVT, automobile tires are subject to Appendix II and are managed by the Ministry of Transport

– Documents need to be prepared including: P/O, INV, PKL, Bill of Lading/Air Way Bill or road bill of lading, 2 copies of KTCL Registration Certificate, Catalogue, Letter of Introduction, Official dispatch to the Department of Registration, etc.

– Submit to: Department of Registration – Address: 18 Pham Hung, My Dinh 2 Ward, Nam Tu Liem District, Hanoi City

– Time to receive KTCL registration certificate: 1-2 days to receive KQ confirmation certificate

Step 2: Open customs declaration and clear goods

Customs documents as well as regular goods, including:

  • Import goods declaration
  • Commercial contract (Sale Contract)
  • Bill of Lading (Air Waybill)
  • Commercial invoice (Commercial Invoice)
  • Packing list (Packing List)
  • Certificate of Origin (C/O), (if any, to enjoy preferential import tax)
  • Registration for state inspection of imported goods quality.
  • The Customs Authority will clear customs based on the dossier with the Certificate of Registration of Goods and Services confirmed by the Inspection Authority

Note: Enterprises must declare the exact price of goods for the order, otherwise they may be consulted on the price.

Step 3: Make a certificate of conformity for automobile tires

Certification of conformity requires testing and CNHQ with a quantity of >100 samples

Testing according to QCVN 34:2017/BGTVT

– Send samples for testing with the technical documents of the product

– Time: within about 15 working days will have the result

Step 4: Declare conformity of automobile tires

With a quantity of <100 samples, there is no need to bring the samples for testing but make an HQ declaration

– Prepare a complete set of documents for declaration of conformity

– Time: from 5-7 working days from the date of submission of valid documents.

4. Conformity declaration process

What is conformity certification?

Product conformity certification is the activity of evaluating and confirming a specific type of product or commodity regarding its level of conformity with the corresponding standards.

Specifically, technical regulations are understood as regulations on the limits of technical characteristics and management requirements for a specific product. Implementing this product conformity declaration will bring many benefits such as:

  • For manufacturers: Creating customer confidence in product quality, enhancing the reputation and brand image of the enterprise while increasing competitive advantage.
  • For consumers: Using quality products that meet standards without having to worry about the level of impact on safety and health
  • For control agencies: Ease in the quality inspection process.
    Certification of conformity to technical regulations is mandatory. The method of assessing technical standards applicable to each specific subject is specified in the corresponding technical regulations.

Specifically, for Tire products, it is necessary to carry out procedures for declaring product conformity before putting them on the market according to national standards, specifically:

  • QCVN 36:2010/BGTVT for motorcycle tires
  • QCVN 34:2017/BGTVT for automobile tires

4.1 Tire conformity declaration dossier

Tire conformity declaration dossier includes:

  • Sample product
  • Application for conformity declaration according to the form
  • Copy of Business Registration Certificate or Investment Certificate
  • Certificate of Analysis: 02 originals or certified copies (regarding main quality indicators, quality indicators and related hygiene indicators).
  • Certificate of Free Sales issued by the exporting country
  • Product label or photo of product label and draft of supplementary label content

4.2 Implementation time
