Canada conducts administrative review of “double tax” on Vietnamese upholstered chairs

According to information from the Vietnam Trade Office in Canada, on November 24, 2024, the Canada Border Services Agency (CBSA) announced the initiation of an administrative review of anti-dumping and countervailing duties on upholstered chairs (UDS) originating or imported from China and Vietnam, and imported from the United States by Ashley Furniture Industries LLC.

According to CBSA, this review aims to update the normal value, export price and subsidy level for upholstered chairs.

The review was conducted in accordance with the Canadian International Trade Tribunal (CITT) findings issued on September 2, 2021, and in accordance with the Canada Border Services Agency’s administrative review policy, following a request for review by an importer.

The CBSA said that the information collected during the review will be used to determine and update anti-dumping and countervailing duty rates for future imports under the Special Import Measures Act (SIMA).

The CBSA is expected to issue the review results on May 22, 2026.

In the event that the business (for anti-dumping duty review) or the Government (for countervailing duty review) fails to provide sufficient information or does not cooperate with the review, the CBSA may impose a duty based on the information available.

Specifically, with anti-dumping tax up to 179.5% on export price for Vietnamese goods, and provisional anti-subsidy tax of VND 1,914,726.79/piece.

Therefore, to protect the legitimate rights of Vietnamese UDS product manufacturing/exporting enterprises, the Department of Trade Remedies (Ministry of Industry and Trade) recommends that related manufacturing/exporting enterprises study relevant Canadian legal regulations.

At the same time, provide full information requested in the Investigation Questionnaire and fully cooperate with the Canadian investigation agency throughout the review process.

Previously, in August 2021, after the investigation process, the Canada Border Services Agency issued the final conclusion in the case of Canada’s anti-dumping and anti-subsidy investigation of upholstered chairs originating from Vietnam.

Most of the cooperating enterprises had their dumping margins significantly reduced, leading to the final average tax rate of most enterprises ranging from 10 – 20% (compared to the preliminary level of 20 – 90%).
