Procedure for applying for C/O at the Ministry of Industry and Trade
The Ministry of Industry and Trade is the agency that organizes the issuance of Certificates of Origin for export goods; directly issues or authorizes the Vietnam Chamber of Commerce and Industry and other organizations to issue Certificates of Origin for goods.
Currently, the Ministry of Industry and Trade has the right to issue C/O. This Ministry authorizes a number of agencies and organizations to undertake this task. Each agency is authorized to issue certain types of C/O, specifically as follows:
- Vietnam Federation of Commerce and Industry (VCCI): issues C/O forms A, B, TR, X…
- Import-Export Management Departments of the Ministry of Industry and Trade: issue C/O forms D, E, AK, AJ…
- Export Processing Zone-Industrial Zone Management Boards authorized by the Ministry of Industry and Trade: issue C/O forms D, E, AK…
1. WHY DO YOU NEED TO MAKE C/O?
– Tariff preferences: Identify the origin of goods to distinguish which imported goods are entitled to preferences and apply preferential treatment according to trade agreements signed between countries
– Apply anti-dumping and subsidy taxes: In cases where goods of a country are dumped in the market of another country, identifying the origin makes anti-dumping actions and the application of anti-subsidy taxes possible
– Trade statistics and maintaining the quota system: Identifying the origin makes it easier to compile trade statistics for a country or a region. On that basis, trade agencies can maintain the quota system.
– Promote trade between countries and economic blocs.
2. PROCEDURE FOR APPLYING FOR C/O AT THE MINISTRY OF INDUSTRY AND TRADE
Step 1:
– For enterprises applying for C/O for the first time, before preparing C/O documents, they must fully fill out the Trader’s Profile (see more at www.ecosys.gov.vn)
– If applying for C/O at the VCCI HCM Branch and submitting it to the C/O Department, VCCI together with 1 copy of the Business Registration Certificate and 1 copy of the Tax Code Registration Certificate of the enterprise.
Step 2: Scan the trader’s profile and submit it online to the ecosys system for approval. Enterprises must fully prepare the C/O Application Profile as follows:
– C/O Application: Fill in all boxes on the form and have the seal and signature of the authorized person of the enterprise.
– C/o form (A, B, D, E, AJ, AK, VK, VJ,…)
– Commercial invoice: 1 original issued by the enterprise.
– Export customs declaration: completed customs procedures (1 copy with red seal, signature of the authorized person of the enterprise, and “Certified copy of original” stamp), except for C/o batches for air cargo that do not need to complete customs procedures and must be requested 1-2 days before departure.
– Packing List: 1 original copy of the enterprise
– Bill of Lading: 1 copy with red seal, signature of the authorized person of the enterprise, and “Certified copy of original” stamp.
– Production process
Step 3: Declare online on the Ecosys system (Ministry of Industry and Trade License) or Comis (VCCI License), wait for the enterprise to receive the number to print the C.o draft that has been declared on the system.
Step 4: Submit the application directly to the Ministry of Industry and Trade and VCCI to wait for licensing, stamp and receive the licensed certificate based on the prescribed time or the time on the application receipt.
